These Terms and Conditions apply to your use of the Tellmee.app website (portal) and the TellMee app (the app) and the features, applications, services, technologies and software offered by us (the products), except where we expressly state that separate terms and conditions (and not these terms and conditions) apply.
Our goal is to bring authenticity back to the online space. We also want to enable people of common feeling and perception to connect with each other and move towards a world of understanding and appreciation. To do this we use the following services:
We provide an environment for publishing your videos:
With Tellmee, you can record authentic videos, quizzes and challenges and share them online and on other apps. Your video summaries are only available to you and the users you give access to or invite to collaborate on your videos.
We recommend interesting quizzes or challenges:
To improve the user experience, we present the most current and most requested quizzes or challenges on the homepage of the app.
We allow you to interact with others and invite them to create together:
In TellMee, you can send invitations to friends you want to invite to make a video together.
We protect a safe environment:
Above all, TellMee is a space where you can feel safe. We use a variety of methods to detect when someone is being offensive, attacking others, spreading hate, or misusing our products. When we become aware of such behavior, we remove content, block the use of abused features, and work with the appropriate authorities when necessary.
Working with advertising:
You may find commercial advertising in TellMee if you use the free version of the app. The paid version of the app is currently being developed.
In order to provide the above services, we store your data. You can find out exactly how this happens, how we handle the data and how we store it in our Personal Data Processing Policy.
In order to fulfil its main purpose, the app needs access to the camera (video recording) and to the phone's storage (video storage).
In order to meet our goals and to keep the TellMee environment safe, we need you to do the following:

To keep the TellMee space safe, we need your cooperation. It's the only way to make us all feel comfortable and safe here. So you are not allowed to share or post anything:
You may not post or upload viruses or malicious code or do anything that could overburden, disable, block or otherwise interfere with the proper functioning or appearance of TellMee and our services and products.
You must not collect data from our products by automated means, or use the system in this way, or attempt to access data that you are not authorised to access.
If the content you post violates any of these terms, we may remove it, hide it, and take action against your account if necessary. Your account may also be disabled if you repeatedly violate any of the rights of others. You may be notified of the removal of content if it is technically, legally and temporally feasible to do so.
If you feel that another TellMee user is violating your rights, please report them to help keep the space safe.
3. Permissions you grant to TellMee
In order to provide our services in accordance with the law, we need the following authorisations from you:
Permissions to use the content you create and share: What you create in the TellMee space remains your intellectual property at all times. You decide what content you share, publish and send to other users. However, in order for us to do this, we need permission from you to use your content. By posting, uploading, sharing your content (which is covered by intellectual property rights - for example, photos, videos) in connection with our products, you grant us a non-exclusive, transferable, royalty-free, worldwide license to store, use, distribute, modify, execute, copy, host, publicly display or perform, and create derivative works of your content. In practice, this means that in order for us to store, for example, a photo you have uploaded, you are giving us permission to store it on a server, host it, host it with our service providers, and display it on the TellMee App. You terminate this license by removing your work, your content. For technical reasons, the content may remain stored with us in backup copies for a short period of time, even if it is no longer visible to other users, before it is physically removed.

4. Restrictions on use for our intellectual property
If you wish to modify and use our design, this is possible with prior written consent. If you wish to copy, decompile, modify, create derivatives of, or attempt to extract our source code, you must have our written consent or permission under an open source license.
1. Updating our terms and conditions
We are always trying to improve the TellMee service and this is sometimes reflected in adjustments to these Terms of Service. Unless otherwise required by law, we will always notify you by email at least 30 days prior to modifying the Terms of Service. This will give you the opportunity to decide whether you agree to them and to continue using Tellmee. By using Tellmee after the date on which the new terms become effective, you agree to these terms. If you do not agree to the terms, you may delete your account or uninstall the application.
2. Suspension or termination of the account
TellMee is meant to be a safe place where people are not afraid to open up and share their feelings and lives. For this reason, if we find that you have demonstrably or repeatedly violated our Terms of Service or any of our other policies, we may suspend or block access to your account. Likewise, we may suspend or disable your account if required by law. We will notify you of these actions the next time you attempt to log in or use your account. This will also provide you with information on how to proceed if you consider the blocking or suspension to be unjustified or if you believe it was blocked in error. If you remove the account yourself or we block it, these terms and conditions will also cease to apply but the provisions of section 4 will remain in force.
3. Limitation of liability
Despite our best efforts to provide our services and products safely and without interruption, TellMee may occasionally be unavailable or defect-free. To the extent that we have exercised reasonable care and diligence, we will not accept liability for losses not caused by our breach of these Terms of Service or our other conduct, losses that are not foreseeable by you or us at the time you agree to these Terms of Service, for inappropriate, obscene, illegal, offensive or otherwise unacceptable content posted by others in a space beyond our control, or for events beyond our reasonable control.
4. Dispute Resolution
We will define clear and as clear as possible rules to reduce or avoid disputes. However, when a dispute does arise, it can be useful to know how to resolve it. If you are a TellMee user residing in a member state of the European Union, the laws of that member state will apply. You can then pursue your claim in any court of competent jurisdiction. For all other cases, you agree that claims must be resolved in a court of competent jurisdiction in the Czech Republic and that the laws of the Czech Republic will govern these Terms and Conditions and all claims, except for specific conflict of law provisions.
5. Next
These Terms of Service constitute the entire agreement between you and Maitreya Association, the administrator of the TellMee Project, regarding your use of our products and services. They supersede all prior contractual arrangements.
If any part of these terms and conditions becomes unenforceable, the other parts shall remain in full force and effect. If we do not exercise our rights under any part of these terms and conditions, this will not be deemed a waiver of those rights. All amendments or waivers relating to these Terms and Conditions must be in writing and signed by us.
You will not assign any of your rights or obligations under these Terms and Conditions to any other person without our consent.
In the event of death or incapacity, you may designate an authorized contact person to manage your account. Only such designated contact person or the person you have named in a valid will or other document expressly consenting to the accessibility and management of your content may request access to your account in the event of death or incapacity.
These Terms of Service do not grant any third party beneficiary rights. All of our rights and obligations under these Terms of Service are fully assignable in the event of a merger, acquisition or transfer of assets, or in any other case where such assets are transferred by operation of law or otherwise.
Please note that in certain situations (for example, if another person claims a username and it turns out to be unrelated to the name you use in your private life), we may change your username.
